Novell Recovers over $13.8 Million Worth of Illegal Software in Settlement Settlement Also Includes Cash and Equipment From Southern California Company PROVO, Utah -- April 28, 1998 -- Novell, Inc. announced that it has recovered unauthorized copies of Novell's NetWare product with a market value of over $13.8 million in its settlement with Comptek, a Southern California based company. The lawsuit was originally filed in the United States District Court, Central District of California, Western Division against Comptek and its owner, Steve Angelica. The lawsuit alleged that Comptek sold unauthorized copies of Novell NetWare product and used the Novell and NetWare trademarks in violation of Novell's rights. Both parties agreed to a settlement that includes Comptek turning over the unauthorized product to Novell, along with a nominal cash sum and includes transferring ownership of computer equipment from Comptek to Novell. "We are very pleased with the settlement reached in this case," stated David Bradford, senior vice president and general counsel for Novell. "Novell has proven over and over that we will go to great lengths to protect our authorized distribution channel and assist them in competing on a level playing field." Novell investigates over 500 cases worldwide each year. More than $11 billion is lost to software piracy every year, according to the Business Software Alliance (BSA) and Software Publisher's Association (SPA).
